This Privacy Policy explains how CGI Marine LLC, a Delaware limited liability company ("CGI Marine," "we," "us," or "our"), collects, uses, shares, and protects personal information in connection with the Skydancer Marine application and website at app.skydancermarine.com (the "Service"). By creating an account or using the Service, you acknowledge that you have read and understood this Privacy Policy.
CGI Marine LLC is the controller of personal information processed through the Service.
We do not currently maintain an establishment in the European Economic Area (EEA) or the United Kingdom. If we become required to designate a representative under Article 27 of the GDPR / UK GDPR, we will update this Policy with their details.
This Policy applies to personal information we process about account holders (boat owners/captains who create an account and subscribe), invited users (crew, family, mechanics, and others invited to a boat workspace), and website visitors. It does not apply to third-party services you access through links from the Service.
We use RevenueCat to manage subscriptions and entitlements across providers. Payment card details are collected and processed directly by the applicable payment provider — Stripe (direct/web) or Apple/Google (in-app purchases) — and we do not receive or store your full card number. We receive subscription status and limited transaction/billing metadata such as your tier, status, and entitlement history.
Some features may, with your permission, use your device's location — for example, on-site check-in and geofencing on the mechanic/Pro side of the Service. Location access is opt-in; you can enable or disable it at any time in your device settings. We do not use location for advertising or track it in the background. Separately, if you record harbor or port locations, we may query third-party mapping/geocoding sources (for example, OpenStreetMap/Overpass) to resolve place names. The Service is not a navigation or positioning system.
We do not sell your personal information, do not use it for cross-context behavioral advertising, and do not use your content to train third-party generative AI models.
Where the GDPR or UK GDPR applies, we rely on: performance of a contract (to provide the Service); legitimate interests (to secure, maintain, and improve the Service); consent (where required, such as optional push notifications — you may withdraw it anytime); and legal obligation.
Any third party with whom we share user data is required to provide protection at least equivalent to that described in this Policy, consistent with Apple App Store requirements. We do not sell your personal information.
We are based in the United States and process data there. If you access the Service from outside the United States, your information will be transferred to and processed in the United States and other countries that may not provide the same level of data protection as your home jurisdiction. Where we transfer personal data of EEA/UK individuals, we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses (and the UK International Data Transfer Addendum) where required.
We keep personal information for as long as your account is active and as needed to provide the Service.
You can delete your account at any time from within the app (Account settings), consistent with Apple App Store Guideline 5.1.1. When you request deletion, we schedule it with a 7-day grace period during which you can cancel; after that period, we delete or de-identify the personal information associated with your account, except: (a) billing, tax, and transaction records, which we retain for up to seven (7) years to meet legal and accounting obligations; and (b) information we are otherwise required or permitted by law to retain. Routine backups are purged on a rolling cycle, typically within 90 days, and diagnostic/error logs are retained for a limited period (typically up to 90 days).
If you are an invited user, certain records you contributed to a boat workspace may remain with that workspace under the owner's control after you leave.
You may designate a continuity/heir contact for your vessel (Settings → Boat → Continuity; your co-captain by default, or any email address you choose). If you do not sign in to the Service for an extended period (currently 120 days), we may send your designated contact a reminder notice in case of prolonged absence, incapacity, or death. This triggers no automatic changes to your account — no data is deleted and no access is transferred automatically. Any boat transfer occurs only later and manually, after your contact reaches our support team and provides appropriate documentation. The 120-day window is intended to accommodate legitimate seasonal absences (such as winter haul-out or delivery seasons).
We use only the cookies necessary to operate the Service: a session cookie to keep you signed in and an anti-CSRF cookie. We do not use advertising, analytics, or social-media tracking cookies, and we do not track users across third-party sites. Where required by law, we honor recognized opt-out preference signals (such as Global Privacy Control) for any "sale"/"sharing" of personal information — though we do not sell or share personal information as those terms are defined.
Depending on where you live, you may have some or all of these rights:
How to exercise your rights. Use the in-app account controls (export, delete) or email legal@skydancermarine.com. We will verify your request (typically by confirming control of your account email) and respond within the time required by applicable law (generally 30–45 days). You may use an authorized agent where the law allows.
We collect the categories of personal information described above for the business purposes in Section 4. We do not sell or share personal information. Any precise geolocation collected for opt-in features (such as on-site check-in or geofencing) is used only to provide that feature and not to infer characteristics about you, so it does not trigger a right to limit. California residents have the rights above, including non-discrimination and the right to appeal.
Residents of states with comprehensive privacy laws (including Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and others) have the rights in this Section and may appeal a denied request by emailing legal@skydancermarine.com.
You have the rights in this Section under the GDPR/UK GDPR and may lodge a complaint with your local supervisory authority (in the UK, the Information Commissioner's Office).
We use reasonable administrative, technical, and organizational measures to protect personal information, including encryption in transit, encryption of data at rest by our hosting providers, hashed passwords, role-based access controls, and database-level row-level security so each account's ("tenant's") data is isolated from others. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
The Service is intended for adults and is not directed to children. We do not knowingly collect personal information from children under 16 (or the minimum age in your jurisdiction). If you believe a child has provided us personal information, contact legal@skydancermarine.com and we will delete it.
We may update this Policy from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, notify you through the Service or by email. Your continued use after changes take effect constitutes acceptance.
